How EB-5 Compares To Other EB Visas

Hello, and welcome back to our blog! Today we are going to talk about the similarities and differences between various employment-based visas and how EB-5 investment stands out when it comes to economic growth and stability, and how it will lead to permanent residency for you, the investor.

Let’s start off by talking about some of the other EB programs out there.

Foreign researchers belong to the first preference EB-1 program. What this means is that if you are a person with extraordinary ability, an outstanding professor or researcher, or a multinational manager or executive, you will be considered first among employment-based immigration petitions for a visa. If you’re someone who qualifies for an EB-1 petition, you have a significant advantage over EB-2 because you won’t need a labor certification requirement. This certification is expensive and is designed to determine if there is an able and willing U.S. worker to fill a position that the immigrant seeks to gain.

Furthermore, those who qualify as an EB-1 will not have to wait for visa numbers to become available to change status and receive a green card. If you have already applied for EB-1 status, you can still file additional immigration petitions while EB-1 applications are being processed.

 

  • Extraordinary Ability: If you think you belong to this category, you must be able to demonstrate national or internationally acclaimed ability in the fields of science, art, business, education, or athletics.
  • Outstanding professors and researchers: You must have at least three years of experience as a professor or researcher in a specific field to qualify for this category and you must be entering the United States with the intent of working in that field.

 

  • Multinational manager or executive: For this category, you’ll need to have been employed outside the U.S. within three years of your petition and for at least one year. You must enter the U.S. to continue working with this firm or corporation.

Second preference applicants require that you have a job offer and a labor certification approved by the Department of Labor. In addition, the employer must file an Immigrant Petition for Alien Worker form for the applicant. To qualify for this category, you must be a professional holding an advanced degree, or someone with exceptional ability.

Third Preference applicants also require an Immigrant Petition for Alien Worker form completed by the employer. The main difference between this and E2 is that it includes skilled workers, professionals whose jobs require at least a baccalaureate degree from a U.S. university, or unskilled workers.

E4

The Fourth Preference group includes many subgroups of qualified persons such as ministers of religion, certain employees of the U.S. Government Abroad, and broadcasters in the U.S.

The EB-5 Immigrant Investor Program

The Immigrant Investor Program was created during the Immigration Act of 1990, which allows for foreign investors to finance a U.S. business and in turn, gain permanent U.S. residency.

 

  • Return on investments: As a foreign investor who gained a green card through an EB-5 program, you will have money invested in a U.S. company that could see a return on investment. If you are not accepted as an EB-5 investor, your money is returned to you.

 

    • Job Creation: The EB-5 program requires the creation of 10 jobs in the U.S. This will contribute to your future country’s economy and can lead to more job creation opportunities if you choose to pursue them.
